Ægir Prediction Terms of Use

These Terms of Use ("Terms") govern your use of the Ægir Prediction application ("the App") for iPadOS, iOS and macOS, published by Jesse Webber ("we", "us"). By downloading or using the App you agree to these Terms. If you do not agree, do not use the App.

1. Licence

We grant you a personal, non-transferable, non-exclusive licence to use the App on Apple devices you own or control, in accordance with the Apple Media Services Terms and Conditions and the standard Apple Licensed Application End User Licence Agreement (EULA), which is incorporated into these Terms by reference. Where these Terms and the Apple standard EULA conflict on a consumer-protection matter, the term more favourable to you applies.

2. The free tier

The App's core functionality — the propagation solver, the Signal-Excess field, on-screen marine-mammal impact-range figures, the bundled global climatology (GEBCO, WOA23, sediments), ambient-noise estimation, unit tools, local project storage, iCloud sync of your projects, and a watermarked draft brief sheet — is available free of charge and works fully offline. No account or sign-in is required.

3. Ægir Live — auto-renewable subscription

Ægir Live is an auto-renewable subscription that unlocks live ocean and weather data (HYCOM sound-speed nowcast, currents and drift, and GFS wind, wave, sea-surface temperature and weather). It is offered as:

• Annual — US$99.00 per year; and
• Monthly — US$12.99 per month.

Prices are shown in US dollars; your local price and currency are displayed in the App at the time of purchase and may vary by region and applicable taxes.

Auto-renewal. Payment is charged to your Apple ID account at confirmation of purchase. The subscription automatically renews at the same price and period unless it is cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.

Free trial. New subscribers may be offered a 7-day free trial. If you take the trial, the first charge occurs at the end of the trial period unless you cancel at least 24 hours before it ends. Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.

Managing and cancelling. You can manage or cancel your subscription at any time in Settings → Apple ID → Subscriptions on your device, or in the App under Settings → Support Ægir → Manage Subscription. Cancellation takes effect at the end of the current paid period; the live tier continues until then.

What happens if you don't subscribe, or cancel. The App keeps working. Live data simply turns off and the App falls back to the free, offline climatology — no feature you already had is removed. Any export produced while live data is unavailable is labelled with the data source and timestamp it used.

4. Ægir Pro — one-time purchase

Ægir Pro is a one-time, non-consumable purchase (US$199.00) that unlocks the regulator-facing deliverables — the multi-page Formal EIA Report and the cited Methodology PDF, with jurisdiction-stamped compliance framing. It is not a subscription and does not recur. Ægir Pro is independent of Ægir Live; a Pro export is stamped on WOA23 climatology and does not require a Live subscription. Organisations may license Ægir Pro per seat through Apple Business Manager.

5. Tips

The App offers optional one-off tips to support development. Tips unlock no features and are non-refundable except as required by law.

6. Payments, refunds and restore

All purchases are processed by Apple through the App Store. We do not receive or store your payment details. Refund requests are handled by Apple under the Apple Media Services Terms and Conditions; see Apple's refund process. You can restore previous purchases at any time via Settings → Support Ægir → Restore Purchases.

7. Intended use and professional judgement

Ægir Prediction provides modelled estimates of underwater acoustic propagation and noise impact for planning and decision-support. Outputs are predictions, not measurements or guarantees. Real-world conditions vary, models have uncertainty, and forecast skill degrades with lead time. You are responsible for applying professional judgement and, where a result informs a regulatory submission, environmental impact assessment, or operational decision, for independently verifying it against measured data and applicable standards. The App is not a substitute for a qualified acoustician or for required field measurement.

8. Data sources

The physics and bundled data are public-domain or permissively licensed, and the methodology is implemented from published, peer-reviewed equations. Source attributions are listed on the Provenance page. Live data is sourced from public operational models (HYCOM, NOAA GFS) via our data service.

9. Service availability

Live data depends on a network service we operate on a reasonable-effort basis. We do not guarantee uninterrupted availability of live data, and we publish no service-level guarantee. If live data is unavailable, the App degrades gracefully to the free offline climatology so your work is never blocked.

10. Disclaimer of warranties; limitation of liability

To the maximum extent permitted by law, the App and live data are provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose and accuracy. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss arising from your use of, or reliance on, the App or its outputs. Nothing in these Terms limits liability that cannot be limited under applicable law (including the Australian Consumer Law and other mandatory consumer protections).

11. Changes

We may update these Terms from time to time; the "last updated" date above reflects the current version. Material changes affecting paid features will be communicated through the App or this site. Continued use after a change constitutes acceptance.
